Who we are

Magma is a Montreal company that designs, writes and maintains showcase sites for service businesses.

By subscribing, filling a form or using this site, you accept the terms written here. If you do not agree, do not use the service.

What we deliver

We design your site, write your copy in French and English, install your chat bot and put the whole thing online.

You supply your photos, your contact details and the facts about your business.

The usual delay is 7 days between the payment and going live. That is a serious target and not a guarantee, because it also depends on how fast you send us your content.

The price and the taxes

The subscription is $150 CAD a month, plus the taxes that apply in your province.

There is no setup fee.

Payments run through Stripe. Magma never sees your card number.

Renewal

The subscription renews by itself every month on the same date, for as long as you do not cancel it.

A price can change. We tell you by email at least 30 days ahead and the new price only applies to the following renewal.

Cancelling

You cancel whenever you want, from your portal or by writing to us.

Cancelling takes effect at the end of the period already paid. A month under way is not refunded.

When the subscription ends, the site comes off the internet. We keep your content for 30 days in case you change your mind, then we delete it.

What we expect from you

You warrant that you hold the right to use the photos, logos and text you send us.

You answer for the accuracy of the facts about your business, your prices, your hours, your licences and your insurance.

The service is not there to publish content that is illegal, hateful, misleading or meant to harm someone.

If a complaint or a lawsuit arrives because of what you supplied, you take charge of it and you indemnify us for what it costs us.

Who owns what

Your text, your photos and your brand stay yours.

The code, the design and the tools of Magma stay with Magma. Your subscription lets you use them while it is active, nothing more.

You allow us to show your name and a picture of your site in our examples. One email is enough for us to take it down.

The chat bot

The chat bot answers from the facts you give us. It can be wrong.

It is not professional advice, legal, medical or financial. An answer from the chat bot commits neither a sale, nor a price, nor an appointment.

Check what matters before relying on it. We switch it off on request.

Availability

We aim for a site that is online at all times, but no web service is perfect.

Outages happen for maintenance, for a supplier failure or for a cause outside our control. We do not guarantee a precise uptime figure and there is no automatic credit.

The limits of our liability

The service is provided as is. We promise no visitor count, no rank in Google, no sale and no revenue.

Magma does not answer for indirect losses, lost profit, lost customers or lost data.

In every case our total liability is limited to the amount you paid us in the 3 months before the event in question.

Nothing here removes a liability that an applicable law forbids removing.

Suspending an account

We can suspend or close an account when a payment stays unpaid, when the content breaks the rules written above, or when a use puts our infrastructure at risk.

We warn you first, except when the law or an emergency calls for acting right away.

The law that applies

This agreement is governed by the laws of Quebec and by the laws of Canada that apply within it.

Any dispute is settled before the courts of the judicial district of Montreal.

If a clause becomes invalid, the rest of the agreement still holds.

Changes

These terms can change. The date at the top of the page says when.

An important change is announced by email before it applies. Carrying on with the service after that is accepting it.
